Mission

Spiritia will strive to improve the quality of life of PLHAs and assist in creating a supportive and non-discriminative approach to PLHAs by the community. Spiritia’s philosophies and services will take no regard for gender, race, religion/beliefs, socio-economic level, educational background or sexual orientation.

Objectives

  • Empower PLHAs so that they can respond to their own concerns and encourage their involvement in efforts to respond to AIDS.
  • Improve PLHAs access to care and support by starting and maintaining cooperation with related individuals and institutions.
  • Promote an objective and non-discriminative attitude towards PLHAs among decision makers and the general community.

Philosophy

  • Spiritia believes that there is a close relationship between HIV prevention and care/support efforts. Efforts to prevent infection will only be successful if HIV care and support is well-executed and have high regards for human rights.
  • PLHAs, as people whose lives have been directly touched by HIV, are the subject and part of the solution to the problems of HIV/AIDS, not objects and not the problem.

Spiritia was formed in 1995 by Suzana Murni and several other colleagues as a support group for and by people living with HIV. The initial objectives were: 1) provide a safe and confidential environment for PLHAs to meet and share experiences, and 2) provide information about living with HIV/AIDS. During its development, Spiritia was aware that to change an unsupportive environment to become more supportive, Spiritia must work with parties outside the support group. Because of this, Spiritia developed itself and started to carry out a more comprehensive program. Spiritia became a legal entity on 23 June 1997.

The Indonesia Legal Aid Foundation

THE ORGANIZATION’S FUNDAMENTAL VALUES

YLBHI works have been based on the organization’s fundamental values, which include the following principles:

  1. That every individual has the right to justice and therefore, enforcement of law must be made on sustainable basis while building a legal-based, civilized, democratic community. At the same time, any barriers should be overcome;
  2. That justice is one of the main pillars of a law-conscious community that, along with political, social, cultural and economical justice prop and establish structural justice that complete each other;
  3. That due to the structural link, the enforcement of legal justice and elimination of the barriers should be carried out side by side, proportionally and based on the context of justice enforcement and elimination of barriers related to economic, political, social and cultural issues;
  4. That the struggle for and respect to human rights is a sacred task and obligation, and that it is a heavenly gift so that nobody may deprive anybody’s inborn rights;
  5. That making good deed and preventing evil are the essence of the enforcement of truth and people’s conscience in a fair, social mingling. Therefore, maintaining truth before the unfair power is a constructive stance to take;
  6. That legal aid provision represents not only an attitude and action of merit, but also an inseparable part of liberation of the Indonesian people from any oppression, which eliminates the existence and sense of inclusive, refined justice;
  7. That Indonesian plurality requires non-discriminating legal aid, regardless faith, ethnicity, nationality and political adherence (the principle of impartiality), and that justice must consistently be established although it may call for disagreement with individual interests, those of relatives or colleagues.

VISION AND MISSION

Together with all the nation’s social components, YLBHI has the strong commitment to make the utmost effort in order to achieve the following in the future:

  1. A system of law-conscious community which is established upon a just, humane and democratic socio-legal system ;
  2. Legal and administration systems that are capable of providing both procedures and institutions through which every one could benefit from the law (A fair and transparent institutionalized legal-administrative system);

An economical, political and cultural system that opens access for any group or individual to involve in the making of decisions that affect their interests; and ensures that the whole system respects and upholds human rights (An open political-economic system with a culture that fully respects human rights). Ideally, democracy opens the widest possible opportunity for the public to be the subject instead of object of the political struggle of interest. People should be able to represent themselves, rather than having been represented by political interests that overlook their aspiration. The ideal democracy is attempted from the ground, grows along with public awareness of their economic, social and cultural right. A radical democracy, in YLBHI point of view is “…not only to defend cases of the interests of public at large, but also break through the structure that causes the incessant underdevelopment, poverty, oppression and abandonment…”. In the work to develop democratic, participatory and gender-based civil society, YLBHI is carrying the following mission;First, promote political transformation based on people movement and gender. This political transformation is aimed at opening the widest possible space for correction of repressive authoritarianism where YLBHI partners (labors, farmers, students and urban poor community) are most affected. Second, promote and ensure the fulfillment of the economic, social and cultural right since welfare will only be achieved when economic resources are fairly managed by the people. Otherwise, people will remain consumers and providers of cheap work force. Third, fight for and enforce the protection of civil and political right. This is important in order to support the promotion and fulfillment of civil and political right as part of the attempt towards the fulfillment of the fundamental freedom under the concept of civil and political right. The latter presents the base to the fulfillment of economic, social and cultural right as the form YLBHI version of development of ideal democracy.

In order to materialized the above vision, YLBHI will carry out the following mission:

  1. Establish, promote and disseminate the values of democratic and just legal-based state, and uphold human rights in all social segments without condition;
  2. Establish and promote independence and empower the marginalized people in such a way that enables them to formulate, articulate and struggle for and sustain their collective and individual interests;
  3. Develop systems, institutions and other supporting instruments to increase effectiveness of the efforts to fulfill the rights of the marginalized people;
  4. Initiate, encourage, advocate and support law development programs, enforcement of legal justice and national legal reform in line with the viable Constitution and the Universal Declaration of Human Rights.
  5. Promote and develop programs that contain dimension of justice in politics, socio-economic, culture and gender, particularly for the marginalized people
